USE OF OUR FREE SERVICES

According to the terms and conditions of this Agreement, you are granted a limited, non-exclusive, non-transferable, freely temporary license to use the Services as instructed by the free features of the Services. JurisCase reserves all rights not expressly granted in the Services and JurisCase Content. They may terminate this license at any time for any reason.

USE OF OUR SUBSCRIPTION SERVICES

Power to and use of the Subscription Services is in line with these Terms, including any or all terms and conditions placed fourth in a different agreement (Subscription Agreement) between JurisCase and your company, law firm, or other entity (“Subscriber”).

LICENSE GRANT

JurisCase grants clients, during the term of the Subscription Agreement, a limited, non-exclusive, non-transferable, license to access the selected their Subscription Services indicated in the Subscription Agreement with the provisions herein.

AUTHORIZED USERS AND USAGE

Authorized Users are allowed to use the applicable Subscribed Services, solely in connection with the Subscriber’s provision of its legit services to clients or within its practices, educational activities, or business and in a manner that isn’t commercially prejudicial to JurisCase.

LICENSE RESTRICTIONS

Subscriber shall ensure that its personnel, including Authorized Users, don’t share the same passwords or use or access the Subscribed Service when permitted by Section I.B.2, or permitted in writing by JurisCase.

 

TERM AND TERMINATION

Term and Renewal.

JurisCase will provide the Subscribed Services commencing on the Date for the Initial Term stated on the Subscription Agreement (if none is indicated, an Initial Term of one year), after that for successive one-year renewal terms starting on each anniversary of the Effective Date (Renewal Terms), until and unless the subscription is breached.

 

TERMINATION BY SUBSCRIBER.

The subscriber can terminate the subscription

(a) concerning all or any of the Subscription Services, effective at the end of the current Renewal Term or initial term by giving JurisCase written and signed the notice of termination at least 14 days before the beginning of the next Renewal Term 

(b) in accordance to any Subscription Service affected by JurisCase’s material breach of the Agreement, if JurisCase provides solutions to such material breach within 14 days after the user may give JurisCase written notice of such material breach.

TERMINATION BY JURISCASE.

JurisCase may terminate the subscription

(a) before any Subscription Services affected by user’s material breach of the Agreement, if Subscriber finds a solution to such material breach within 14 days after JurisCase gives client written notice of such material breach,

(b) Immediately after giving client written notice, if Subscriber fails to pay any taxes or fees.

(c) At any time, without cause, may give Subscriber written notice of termination.

EFFECT OF TERMINATION.

After termination of the Subscription Services, client’s obligations under these Terms and any Subscribed Agreement shall cease immediately.

TRIAL ACCESS

We may offer limited pre-subscription trials to potential individual users and Subscriber. When you are using JurisCase on trial, you are allowed to use one or more Subscription Services for a limited period, and as determined by us in our sole discretion. All Registered Users of Trial Services are subject to this same terms and use restrictions as Subscribers.

Ownership; Rights to Use

Copyright Rights. You are aware that, aside from the authentic government tasks as well as other public sector materials, this Service possesses facts and information, illustrations or photos and other material (collectively, “Content”) which are safeguarded by copyrights, trademarks, trade secrets or further private rights, knowing that these rights are legitimate and protected by all means, media and technologies that are in existence now or hereinafter formulated. Choice of Law and Forum. This Agreement shall be construed and controlled by the laws of California. By using this service, you agree that any dispute arising from or related to the terms of this agreement will be governed by the laws of California, without regard to its choice of law provisions. By using this service, you agree to personal jurisdiction by the state and federal courts sitting in California.

Arbitration. JurisCase at its sole discretion may submit any controversy or claim arising out of or relate to these Terms of Service to binding arbitration conducted before one arbitrator who is knowledgeable in computer and cyberspace law. The arbitration will be conducted by the then applicable Commercial Arbitration Rules of the American Arbitration Association. The award rendered by the arbitrator will be binding and conclusive on the parties and judgment upon such award may be entered in any court having jurisdiction thereof. Each party will bear its costs and expenditures, which include charges and costs of counsel, relevant to the arbitration.

Selected End Users shall solely be authorized to use the Certified Content for internal functions only and not for reselling or distribution. Selected End Users may download and save insubstantial parts of the chosen data so long as such downloading is conforming to any choice or instruction made or given because of the use or application of the Licensed Content. Licensor and its licensors and affiliates are not involved in offering legal, accounting, tax or other professional guidance or services. If legal, accounting, tax or other expert assistance is required, the services of an efficient expert should be explored.
